Regulatory Environment
- Lawyer advertising is First Amendment-protected; ads (including billboards and national TV) are allowed if claims are not false or misleading.
- The FTC enforces truth-in-advertising and endorsement rules; each state layers its own ethics code (model Rule 7.1) on top.
- Email and SMS marketing must follow CAN-SPAM and TCPA: opt-out links, no unconsented robo-calls.
- No single federal privacy law for marketers; state laws (California's CPRA, Virginia's CDPA, and others) increasingly apply, with more taking effect through 2025-26.
